I make templates for a number of diary and blog tools including blogger. In June two of my layouts were posted here without my permission or any credit to me. I didn't find out about this until early December, when I posted comments on both skins and lodged a complaint. Nothing was done.
Two weeks later I filled in the email form asking when something was likely to be done. I still haven't heard anything from Blogskins.
One skin has now been removed, but the other is still up (even though the theft was commented upon and the correct link given by other users soon after it was initially posted). The skin in question is #1646, 'I love my laptop'.
My question is, what do I do now? I'm not allowed to post another comment on the skin, and there's no point posting another complaint as I doubt it'll be read. There's no contact info on the thief's profile so I can't tell her to take it down. I've been nice, I've been understanding that the people who run this site have a lot to deal with, but what good has that done me?
I'm currently looking into whether Blogskins is legally responsible for the violation of my copyright (and that of my image source, who also had their link removed). As the template is published on their site, they've been fully informed that it is stolen and had ample time to deal with the matter, I would be very surprised if they weren't.
(I have, of course, taken down the templates I was offering on Blogskins. I don't see why the site should benefit from my work when it continues to allow other people to rip it off. And I'd strongly urge anyone else who wishes to protect their copyright to do the same.)

You are asking people to take off their skins?

Likely.

I'm asking blogskins to stop offering the skin for download, as the person who uploaded it had no right to do so.
I have no problem with other people using the skin -- they are an innocent party in this -- but I would ask that, if they wish to keep the skin up, they re-insert the credit links to not-that-ugly.co.uk and intuitivmedia.net.
I'm not particularly interested in getting into flame wars with the child who stole my work. I'm more disappointed that blogskins has ignored, and continues to perpetuate, the violation of my copyright.

An update on this (not that anyone cares):
In the absence of a contact address on here, I did a whois search on blogskins.com and emailed the contact address there. (By the way, anyone registering a domain is LEGALLY OBLIGED to keep this address current.) This was nearly two weeks ago. No reply. Skin is still up.
This site does not care about copyright. And yes, that affects you even if you only download skins made by other people, because if somebody finds you using stolen code or images on your blog YOU'LL be the one who gets the blame. You have the right to be able to download a template without worrying about whether or not you are violating copyright by doing so. It's in your own interests to switch to a reputable template source with templates by reputable designers.
And to any responsible designers still here; I would say find another way of distributing your templates, before you get tarred with the same brush as the thieves.

hmm. i've read the whole thing. people care! just that they can't do anything about it, they don't own the website. a pity you do not put up your designs here, they're really beautiful, mine aren't as good.

Hmm. I just started throwing up a few because I thought it might drive some nice traffic to MY web design site, ya know. But if it's a den of theives, I guess I'll pack up and go back home.
It IS sad. It's not the end-users' fault. Blogskin.com has a bit of an obligation to ensure, as much as it can, that copyrights aren't being violated. Of course, it can't stop people from removing linkbacks anymore than we designers can. But it certainly can take steps to REMOVE a skin that was uploaded without its author's permission.
Pity.
