No, I'm not talking about someone stealing the images that you have edited to make your blogskin. What I am talking about here is how the images that you have edited to make your blogskins were probably actually stolen from another site and not properly credited in return.

Popular sites that are often raided, violated, and uncredited include, but are not limited to:

Deviantart: Yes, it is often listed as a resource on many sites, but it is a resource for its resource (brushes, textures, etc), stock images, and downloadables sections. Those are the only areas of deviantart where people can actually use the art that is featured. If you take art from personal artists who submit in photography, photomanipulation, anime, drawing, traditional art, digital art, or any other section, it is considered copyright infringement and it is theft. In other words, you are just as bad, if not worse, than those people who take your layout and do not give you credit.

Except the individuals on deviantart actually put more time into their art that you did on your layout. Oh and it's illegal to take that art. Oh, and you're not even allowed to use it even if you were to give credit. The bottom line is this: if you don't have written permission from the artist, you are not allowed to use it.

gettyimages.com: You're not supposed to use the images at gettyimages.com, because those are actually images that people submit for sale. In other words, it's just like deviantart. All of the vectors on that site where created and submitted by the artists and were meant to be sold. You can't use them if you didn't buy them.

In other words, you're not only stealing the copyrights but you're stealing the artist's profits. Good going.

Brushes: I'm sure that most people don't realize that you actually need to credit brushes, but you do. You need to credit all resources that you use on your layout, because that is part of the agreement when you download the brushes. You using brushes without crediting is like someone using your layout and taking off the credit link.

It's wrong.

Remedies:
1) scanning your own images from magazines.
2) drawing your own images
3) making your own brushes
4) e-mailing the artist and obtaining legitimate permission
5) buying the rights to the images.
6) using legitimately free image services (stockxchange, etc).

  i didn't know that deviantart we cant just take the image and just link back to the owner. i thought since the brushes just credit can already, then image should also be the same. yayy. at least now i know i wont do that again. :D

  I dont really get it..
For example, if I were to get pics from deviantart that are downloadable and I give credit, it is allowed. If the picture is for sale but I save it or something, it's theft? And what about those that aren't downloadable/for sale, if I were to save it, is that considered theft too?

  O.o i don't really get the "deviantart" part.
okay, lets say if we use an image from deviantart and we do credit the creator when we use it for our blogskins, is it illegal?

  Nope.
Images are uploaded on deviantart for people to use.
As long as you credit, I think there's no problem using the image.

  some pics on DA are for selling purposes.
and it will be shown at th bottom of the image.

like eg. -print available.-
and -CC. something something rights reserved.-

Many people have been using pictures from DA, etc without actually getting permission. And they think that just by putting a link back to deviantart.com would be enough :(

  but i think it's actually quite difficult to achieve approval for some images, and some of the image designers did specify that the images are allowed to be used for blogskins/non-official purposes.
and anyway, i feel that only giving links and credits back to the designers are although not very nice, but most people can't help it cause they just know photoshop only, and they are not very talented in the aspects of making brushes/making images/drawing/stuff.
yea, i'm defending myself and many others cause i do that and i don't like the adjective "theif"

  Remedy 1 is not appropriate either.

A huge bulk of blogskinners have been just ripping images as and when they like and it's not nice. Seriously. Just imagine someone just ripped your skin. The artists from communities such as DA put in much much more effort into their artworks then most of us do in our skins so at least ask for permission before using the images. It's the least we can all do.

  2 things:

1) I asked the people running pixelgirlpresents.com whether we can use their desktop wallpapers and images for blog designs and their exact reply was:

Hi!
That is VERY illegal:-) In fact, if you could email me if you happen
to see any, please let me know?

So in short, we can't.

2) A tip for remembering where you get images: rename them with the site you got them from or make a folder of all the images / brushes you get from a certain site and name it with the site name.

It means a lot to the people who made these things that we credit them, and since we're using their stuff, we probably should make more effort to do so.

  And about how difficult it is to get approval...

it really is hard sometimes, and frustrating when the owner of the image keeps changing his or her mind. but when we think about how much effort they put in making it (my last DA submission took about three days of staring at the computer), then we might realize it's a small price to pay for the image / brush use.

let's try putting ourselves in their situations.

  Gah. I always just credit the Deviantart user. :/ Is that considered violating copyright laws too? :/
And I can't possibly draw my own images... I'm not talented in art or anything D:

  I think that a lot of people who are new to submitting skins should read this thread. Not because I'm.....jealous or whatever ya know. I knew what was the mistake I made in the past and now I leave the images of dA alone totally.

If....... someone could actually make the same layout from a stock image without the dA-artist's enhancement's picture, I think you then really deserved a compliment from everyone otherwise no. The credit will mostly go to the dA artist himself/herself since without that image, the mood won't be there, the "WOW-ness" won't be there anymore.

Right?

It should be compulsory that one credit all the resources they've used when designing their layouts. Every single thing, brushes, textures, patterns, scans etc. Because w/o them, you can't make the layout where everyone go "WOW WOW WO" about them yeah? :)

  sometimes they take kinda long to reply but ohwell. and i did take some pictures from DA too. :l
but recently i created an acc to ask for permission. ohyeah. if they put under the image sth like: Some rights reserved. This work is licensed under a Creative Commons Attribution-Noncommercial-No Derivative Works 3.0 License.
If it states non-commercial and we arent using it for commercial, then?

  well for deviantart, it doesnt apply to everyone.
if the person actually asked the artist's permission, then it would be legal.
am I right?
well so, I suggest to everyone that they should ask the permission of the artist before
editing and making the skin.

oh, btw, fatalistic_pessimism thank you for making it clear so that the newbies know it. ;)

  so... on DA, even if the artist didn't put "copyright (nameofartisthere), i shouldnt use the image for skins? :o

if yes, must i remove skins that are... urm... with these images?....

I already wrote to the person immediately upon finding out that they credited my site but it's still stealing when the use it as their own. Who do I need to contact to get them taken down and their account suspended? I run PrisonBreak101.net and I need to make a complaint -- please reply.

  The easiest is to snap a photo by yourself.
Get a camera and do the job, and yeah.

  Ok so we cant credit we have to ask permission but what about BUYING the pictures ??? and also some sites alow downloading and usage of their pics EXAMPLE: xbox 363 has a new campaing for almost all types of blogs where new games turn into background images. and they make it so u can DL them. hence they give concent for u to use them. but still just check with the authur or something first before you use it just to be safe =)

  i own a graphic site, and in my TOS I've stated that my images, HTML/CSS are not allowed to be used for ANOTHER layout, but yet I've come across some people here at blogskins that violated that TOS.

I mean, even if you want to "steal" my coding, at *least* modify a little bit and not link me back (stating that I "helped" in the creation of that layout), to save me the irritation.

Is there any way I can report the user?
